Terms & Conditions

By emailing your submission to The Other Hundred, you (“the participant”) participate in The Other Hundred and you hereby acknowledge and agree to be bound by these Terms and Conditions. Please read and these Terms and Conditions before submitting to The Other Hundred.


1) CONTEST RULES

The Other Hundred competition begins on December 15, 2012 and ends on April 1, 2013 (now extended to April 7, 2013, 12:00pm Hong Kong time). Winners will be notified within 45 days after the deadline or extended deadline day.

Each participant may submit one or more Series, defined as a set of photos built around an individual or a small community, with a strong narrative focus. The Series may contain one or more photos. The Other Hundred competition judges will evaluate the Series submitted by each participant.

You agree to be bound by these Official Rules and that the decisions of the judges are final on all matters relating to The Other Hundred.


2) PARTICIPANT RESPONSIBILITIES

By submitting to The Other Hundred, you participate in the Other Hundred and you hereby acknowledge and agree to be bound by these Terms and Conditions. 

Given the editorial nature of this project, participants are not required to obtain model release prior to submission of the photograph(s).  However, if the submitted photograph(s) contain any material or elements that are not owned by the participant and/or that are subject to the rights of third parties, and the participant wishes to use the photograph(s) in future commercial purposes outside the scope of The Other Hundred, we recommend the participant be responsible for obtaining any and all releases and consents necessary. 


3) THE OTHER HUNDRED RESPONSIBILITIES

The Other Hundred will credit the amount due to the winners within 60 days of the winners announcement, provided that the winner communicates via email to The Other Hundred (i) valid bank account information within 30 days after the winners announcement or (ii) mailing address and beneficiary name for cheque payment.

The Other Hundred will respect and cite author copyright information. When the participant submits photographs to The Other Hundred, the participant remains the copyright owner of the photographs the participant submits to The Other Hundred and The Other Hundred does not claim ownership of photographs the participant submits to The Other Hundred.

The Other Hundred does not retain the right to use your images for any commercial use, without your prior written consent.


4) RELEASES

By submitting to The Other Hundred, you make the following guarantee:

By submitting photograph(s) to The Other Hundred, I declare that I am authorized by the holder of the copyright (or the right to copyright) to submit photographs to The Other Hundred. I grant permission to The Other Hundred to use my submitted photographs in exhibitions, in publications, and in promotional materials, and for educational, research, and historical record purposes concerning The Other Hundred, without any remuneration being due. This usage includes, but is not limited to, slides/tapes, television film/tapes, videodisc, DVDs, CDs, websites, and any other type of mechanical, electronic, or digital dissemination systems.

I further guarantee that, to the best of my knowledge, no third party can claim rights or raise objections to the publication/reproduction/distribution of the material submitted.

Neither The Other Hundred nor their associates, affiliates or partners assume any responsibility for photos submitted in violation of these Terms and Conditions. Images that violate copyright and/or competition policies will be removed and disqualified by The Other Hundred after an investigation is conducted.


5) LIMITATION OF LIABILITY

By participating, the participant agree to release, discharge, and hold harmless The Other Hundred and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in The Other Hundred or any activities related to The Other Hundred.

The Other Hundred assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in the operation of the website or related email accounts; communications line failure; theft or destruction of or unauthorized access to The Other Hundred submissions; or alteration of submissions. The Other Hundred is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to participants’ or any other persons’ computers related to or resulting from participation in The Other Hundred.


6) DISPUTES

You acknowledge and agree that these Terms and Conditions, as well as any claim that might arise between you and The Other Hundred, shall be governed and interpreted according exclusively to the law of Hong Kong. You further acknowledge and agree that the courts of Hong Kong shall be the exclusive forum where you agree to resolve any claim, cause of action or dispute between You and The Other Hundred arising out of or relating to this Agreement.


7) CONTEST CANCELLATION OR SUSPENSION

If for any reason The Other Hundred competition cannot proceed as planned due to any causes beyond the control of The Other Hundred, The Other Hundred reserves the right, at their sole discretion, to cancel, terminate, modify, or suspend the competition.
